Arbitration shall be conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association or such other rules as the parties may agree, applying laws of the state of New York. Judgment on the award rendered may be entered in any court of competent jurisdiction. The parties expressly waive the right to participate in mass arbitration as a member of a class.

Claims shall be heard and decided by a single arbitrator. The place of arbitration shall be the county of residence of the party not initiating the arbitration. The arbitrator will have no authority to award punitive or other damages not measured by the prevailing party's actual damages, except as may be required by statute. The arbitrator may determine how the costs and expenses of the arbitration shall be allocated between the parties but shall not award attorneys' fees. Except as may be required by law, neither a party nor an arbitrator may disclose the existence, content, or results of any arbitration hereunder without the prior written consent of both parties. The parties shall each bear their own attorney's fees incurred in connection with the claims.
